ICJ upholds two of Yerevan's objections and rejects one
YEREVAN, November 13. /ARKA/. Yesterday, the International Court of Justice in the Hague ruled to uphold the first and third preliminary objections raised by Yerevan in the case "Azerbaijan vs. Armenia," while rejecting the second.
Armenia raised three preliminary objections.
1. The Court lacks temporal jurisdiction over Azerbaijan’s complaint, particularly regarding events that occurred between July 1993 and September 15, 1996. During this period, Armenia supported the Convention on the Elimination of All Forms of Racial Discrimination, while Azerbaijan opposed it. Armenia argues that these complaints should not be accepted, according to Armenian Public Television.
2. The Court does not have subject matter jurisdiction to hear Azerbaijan's complaints regarding the alleged laying of mines. When deciding on its subject matter jurisdiction regarding landmines, the Court must first consider Azerbaijan's complaint that Armenia violated norms by laying such mines, and that the evidence also shows that this constitutes an attempt at ethnic cleansing. Armenia notes that Azerbaijan did not request proof that the laying of mines itself constitutes a violation of norms.
3. According to the third preliminary objection, the court lacks subject-matter jurisdiction to consider Azerbaijan's environmental complaints under the Convention on the Elimination of All Forms of Racial Discrimination.
On Tuesday, the International Court of Justice rejected two preliminary objections raised by Baku in the ‘’Armenia vs Azerbaijan’’ case concerning the application of the Convention on the Elimination of All Forms of Racial Discrimination.
In the Hague court, Armenia accuses Azerbaijan of crimes against Armenians, including murder, torture, and inhuman treatment.
On September 16, 2021, Armenia initiated legal proceedings against Azerbaijan for alleged violations of the International Convention on the Elimination of All Forms of Racial Discrimination.
On 21 April 2023, Azerbaijan filed preliminary objections to the Court's jurisdiction, and the proceedings were suspended pending the publication of the Court's decision. By a decision on 25 April 2023, Armenia submitted its written observations and position regarding Azerbaijan's preliminary objections.
Public hearings on the preliminary objections were held from April 15 to 19 of this year. -0-
